CONDITIONS OF EMPLOYMENT

The purpose of these Terms and Conditions is to regulate the purchase of products or services through the website.

By placing an order on this website, the Consumer accepts all the terms and conditions set forth herein.

  • General Information

This service is the responsibility of Salvaje Bike S.L. (hereinafter Salvaje), with address at C/ Valdemorillo 50-A 28925, Alcorcón - Madrid and NIF nº B87761391, entity registered in the Mercantile Registry of Madrid, Volume 35675, Folio 125 General Section, Page M-641138 and 1st Inscription.

  • Territorial scope

The scope of the sale of products and services through the website is limited to mainland Spain, the Balearic and Canary Islands (hereinafter, the "Territory"), so it will not be possible to ship to destinations outside the Territory.

  • Placing an order

In order to purchase any of the goods or services offered on this website, the Consumer must be legally entitled to do so in accordance with Spanish law.

Consumers must search for the product or service they are interested in. For each product, a descriptive sheet will appear with details of the product's characteristics and price including taxes.

Once the Consumer has chosen the desired product or service, he/she can purchase it by clicking on the "Add to cart" button. The products selected by the Consumer will be added to their "Shopping Cart".

To complete the purchase, the Consumer must fill in the purchase form with their details, select the desired means of payment and continue with the process by following the instructions displayed on the screen.

  • The fields in the registration form marked with an asterisk must be completed in order to continue with your purchase.
  • This registration is done in order to be able to process the order, make the shipment, billing and manage your personal data. In this way, you will have to enter all the data necessary for this, including payment details.
  • Confirmation of purchase. The Consumer who has purchased a product or service will receive an e-mail confirming the purchase and the corresponding charge. Payment for the product will be made through the payment gateway or payment method chosen by the Consumer.
  • Completion of the purchase.
  • Promotional campaigns and discount coupons

Promotional campaigns and discount coupons available on freds.cc are temporary campaigns and are subject to the specific conditions of each coupon or promotion.

The difference of a product purchased prior to the date of a possible promotion or commercial action will never be reimbursed.

Promotional products, with special discounts, are subject to a cost of 10€ in case of return. As well as products that are returned more than 1 time for non-justifiable reasons.

A return of a used product will never be accepted.

Fred's Cycling Obsession reserves the right to modify the end dates of the campaigns as well as the products and categories valid for the same. It may not validate the discount coupon on products that already have a discount applied.

  • Products in Outlet

Nutrition products in the liquidation period are new and fit for consumption in all cases. The best-before dates marked on the manufacturers' packaging are dates that indicate an estimated limit of preservation of 100% of the product's properties and qualities even if the optimal preservation conditions have not been taken care of. Our products are stored in the shade and at stable temperatures all year round between 10 and 15 degrees, so they retain their original conditions for months after the best-before date.

All products in the Outlet category are new products and the conditions under which the product has been presented in the Outlet category are indicated on each product sheet.

Discounts on products in the Outlet category can vary between 10% and up to 90%.

Additional discounts such as discount coupons or conversion of discount points from the online shop cannot be applied to these products.

  • Price and payment methods

The price of the goods or services offered is indicated next to the price and includes all applicable taxes; however, orders from the Canary Islands may involve additional costs for the Consumer depending on the legal requirements of the Canary Islands.

Shipping costs will be charged to the Consumer, unless the order reaches the minimum values indicated on the website to obtain free shipping. Free shipping will only be applicable to mainland Spain and the Balearic Islands, never outside thisterritory.The free shipping is fixed from a minimum and final purchase for a total value of €40, including discounts and taxes.

The promotion of free shipping costs from 40€ for mainland Spain and Balearic Islands starts on 20 March 2020 and ends on 20 March 2021.

From 20 March 2021 the fixed shipping costs will be 2.95€ for all purchases.

The prices indicated in the special offers are subject to availability and stock, prevailing in any case the updated price shown on the website.

Payment by card

It is done through the payment gateway with Ibercaja's secure server. Salvaje Bike S.L. or the commercial brand Fred's cycling obsession will not store any data of the payment cards, as these are introduced by the consumer through a secure payment gateway, property of the bank.

Salvaje Bike S.L. or the commercial brand Fred's cycling obsession will only receive from this gateway the confirmation that the payment has been made correctly in order to proceed with the shipment of the order.

Most credit and debit cards are supported. This payment method is immediate. Once the payment has been made, Salvaje Bike S.L. or the brand Fred's cycling obsession, after verification of the data, will start to process the order. This payment method has no additional costs for the consumer.

Payment by PayPal

PayPal is a fast, simple and secure payment system through which consumers can make payments (whether or not they are registered) with their debit card, credit card or bank account. This payment method is immediate. Once the payment is made, Salvaje Bike S.L. or the brand Fred's cycling obsession, after verification of the data, will begin to manage the order. PayPal will be the only one that will receive and use the payment data being an intermediary between the consumer and Salvaje Bike S.L. or the brand Fred's cycling obsession. The payment is made through a secure gateway, external to the website of Fred's cycling Obsession and the data will travel encrypted for greater security. Once the payment has been made and the order has been placed, changes to the delivery address are not permitted. This payment method has no additional costs for the Consumer.

Cash on delivery (if activated)

The Consumer may pay the full amount to the courier, parcel or logistics company delivering the purchased product.

This payment method has an additional cost of 2 euros plus VAT which will be automatically calculated and included in the purchase process.

At the time of purchase you do not have to leave your bank details.
SeQura will inform you of the terms and methods of payment via email and SMS.

Delivery of products

The products will be sent by DHL express courier and will be delivered within a maximum of 24/48 working hours. However, in the event that the Consumer resides in the Canary Islands, this period may be increased depending on the usual processes of the courier company.

The delivery of orders will be made to the delivery address freely designated by the consumer. Salvaje Bike S.L. or the brand Fred's Cycling Obsession assumes no responsibility for any false, inaccurate or incomplete information provided by the Consumer or when the delivery cannot be made for reasons beyond the control of Salvaje Bike S.L. or the brand Fred's Cycling Obsession, such as the absence of the recipient.

In the event that an order is not collected by the Consumer and the goods are returned to Salvaje Bike S.L. or the brand Fred's cycling obsession, the return to the warehouse will incur transport costs that will have to be covered by the Consumer. In this case, provided that the order is cancelled, the same conditions as for the withdrawal will apply. In the event that the consumer requests the re-shipment of the order, he/she will be responsible for all shipping, return and reshipment costs through the payment system provided by Salvaje Bike S.L. or the brand Fred's cycling obsession.

The good shall be deemed to have been delivered when the transfer of its material possession or control has been made to the consumer or to a third party designated by the consumer.

The Consumer must check, upon receipt of the order, if there were any transport damage within 24 hours of receipt Salvaje Bike S.L. or the trademark Fred's cycling obsession will not accept claims after this period, as this is the time given by the transport agencies to claim for any damage suffered during shipment. You must also state this on the carrier's delivery note indicating for example: "BULK VISUALLY DAMAGED".

Offers subject to purchase according to promotion

Products that include additional services such as personalised advice from any of our collaborators, which consists of the resolution of personalised queries by the customer via email. These promotions offer Fred's cycling obsession customers the possibility of resolving questions regarding the training and nutrition knowledge that we offer in our products at no extra cost and in a totally personalised way. In no case do these personalised advisories involve training planning, they are strictly consultancies to resolve customer queries that will be resolved as quickly as possible, and will not exceed 3 emails of exchange.

Consumer Rights

Cancellation or cancellation of orders

The Consumer may cancel or cancel an order that has not yet been dispatched, provided that the promotional period has not yet expired, by sending an unequivocal request by e-mail to shop@freds.cc, stating their full name, postal address, e-mail address, telephone number, purchased goods and order number.

In the event that the order has been dispatched, the Consumer may exercise the right of withdrawal from the contract concluded in accordance with the provisions of the relevant section.

Right of withdrawal

The Consumer has the right to withdraw from the contract signed with Salvaje Bike S.L. or the brand Fred's Cycling Obsession (i.e. to cancel it) within fourteen (14) calendar days from the delivery of the good or the formalisation of the contract in the case of the enjoyment of a service.

The right of withdrawal shall not apply to contracts relating to:

  • When the nature of the good or service makes it impossible to terminate the contract.

  • The provision of services, once the service has been fully performed, where performance has commenced, with the prior express consent of the Consumer and with the Consumer's acknowledgement that he is aware that, once the contract has been fully performed.

  • The supply of goods or services whose price depends on fluctuations in the financial market and which may occur during the withdrawal period.

  • The supply of digital content that is not provided on a tangible medium where performance has commenced with the prior express consent of the Consumer with the knowledge on his part that he consequently loses his right of withdrawal.

  • Sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.

  • Goods which after delivery and taking into account their nature have become inseparably mixed with other goods.

  • Products or items that have been used.

  • Sealed audio or video recordings or sealed software which have been unsealed by the consumer and Consumer after delivery.

  • Services related to leisure activities if the contract provides for a specific date or period of performance.

  • Digital content that is not provided on a tangible medium where performance has begun with the prior express consent of the consumer and consumer with the knowledge that he/she loses his/her right of withdrawal as a result.

  • Goods made to consumer and consumer specifications or clearly personalised.

  • Goods likely to deteriorate or expire rapidly.

To exercise the right of withdrawal, the Consumer must notify Fred's cycling obsession by e-mail to shop@freds.cc, indicating his full name, postal address, e-mail address, telephone number, purchased goods and order number.

If the Consumer so wishes, he/she may use the Cancellation/Withdrawal form available to him/her.

In order to comply with the withdrawal period, it is sufficient for the communication concerning the Consumer's exercise of this right to be sent before the expiry of the period indicated at the beginning of this paragraph.

In the event that the Consumer exercises his right of withdrawal, Fred's cycling obsession will refund all payments received, including delivery costs (unless such costs were the result of the Consumer's choice of a delivery method other than the least expensive ordinary delivery method offered by Fred's cycling obsession) without any undue delay and, in any case, at the latest within fourteen (14) calendar days from the date on which the Consumer informed Fred's cycling obsession of his decision to withdraw from the contract.Salvaje Bike S.L. or the brand Fred's cycling obsession will proceed to make the refund using the same means of payment used by the Consumer for the initial transaction, unless expressly provided otherwise.

Nevertheless, Salvaje Bike S.L. will be able to withhold the reimbursement until the goods have been received, until we receive the products back and verify that they are in good condition and have not been used.

The Consumer shall be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The Consumer shall return or deliver the goods directly to Salvaje Bike S.L. or the brand Fred's cycling obsession, without undue delay and, in any event, no later than fourteen (14) calendar days from the date on which he/she communicates his/her decision to withdraw from the contract. The deadline shall be deemed to have been met if you return the goods before this period has expired.

The Consumer shall bear the direct cost of returning the goods.

Requesting information and lodging complaints

Consumers who wish to request information, make claims or complaints should contact Fred's cycling obsession by e-mail to shop@freds.cc, indicating this in the subject line of the message.

Legal guarantee

Fred's cycling obsession shall be liable to the Consumer for any lack of conformity between the contract concluded and the goods delivered or the service provided which becomes apparent within two (2) years of delivery of the goods, provided that the goods are new.

To do so, the Consumer must contact Fred's cycling obsession by e-mail to shop@freds.cc, leaving a note of this in the subject line of the message.

The Consumer shall have two (2) months to notify Fred's cycling obsession of the lack of conformity from the time he/she becomes aware of it.

The claim expires three (3) years after delivery of the property.

Options for enforcing the guarantee:

  • Repair or replacement of the product, at the Consumer's choice, except where one of the options is objectively disproportionate or in the case of fungible or second-hand goods.

  • Reduction of the price or termination of the contract, at the Consumer's choice, if the replacement or repair cannot be demanded, if the replacement or repair has not been carried out in time and without inconvenience.

  • All returns confirmed after receiving the product in perfect condition will be made within a period not exceeding 72 hours. Such returns do not include the cost of the original shipment if any.

  • Returns are free at Fred's Cycling Obsession. This means that the customer will not pay return shipping to exchange or return their product.

Resolution shall not be possible where the non-conformity is minor.

The price reduction shall be proportional to the difference between the value of the product at the time of delivery had it been correct.

Other pre-contract information

  • The Consumer will be guided through the procedure to be followed for the conclusion of the contract, as well as for the identification and correction of the data provided for the conclusion of the contract through the forms created for this purpose.

  • The Consumer accepts these Terms and Conditions, which will be sent to him/her by e-mail when the purchase is made, so that the company will not file the electronic contract. In any case, these Terms and Conditions shall be permanently accessible from the website.

  • The contract is concluded in the Spanish language, in accordance with these Conditions.

  • Offers shall be valid for the period specified on the Website in each case. In the event that stocks run out before the end date of the offer, a product or service of equivalent quality and price may be provided in agreement with the Consumer.

  • In the event of a return of a purchase, the Consumer is responsible for returning the purchased products in perfect condition as well as the items received, even if these were free gifts added to the purchase.

  • The Consumer may access the essential characteristics of each product or service through its description on the WEBSITE.

Applicable law, jurisdiction and dispute resolution

Applicable legislation

This website is governed by Spanish law.

Specifically, for all matters not regulated in these general conditions, the provisions of, among others, the General Law for the Defence of Consumers and Users approved by Royal Legislative Decree 1/2007, of 16 November, and other complementary laws, such as, for example, Law 3/1991, of 10 January, on Unfair Competition, Law 7/1996, of 15 January 1996, on the Regulation of Retail Trade, Law 7/1998, of 13 April 1998, on General Contracting Conditions, Law 34/2002, of 11 July 2002, on Information Society Services and Electronic Commerce, and Law 7/2009, of 23 November 2009, on Free Access to Activities and Services.

If any clause included in these general conditions is declared totally or partially null and void or ineffective, such nullity or ineffectiveness shall only affect such provision or the part thereof that is null and void or ineffective, and the general conditions shall remain in force in all other respects, and such provision or the part thereof that is affected shall be deemed not to have been included.

 

Jurisdiction

For any dispute relating to a contract made by a person who holds the status of Consumer in accordance with the provisions of current legislation, the Courts and Tribunals corresponding to their domicile shall have jurisdiction.

In all other cases, the Courts and Tribunals of the City of Madrid shall have jurisdiction.

General Privacy Policy

The personal data provided during the purchase process will be incorporated into a file under the responsibility of Salvaje Bike S.L. or the commercial brand Fred's cycling obsession with the purpose of managing the sale in accordance with what is specified in the present Conditions.

 

Consumers may exercise their rights of access, rectification, cancellation and objection by sending a letter or e-mail to the addresses indicated at the beginning of these Conditions, providing a copy of their ID card or equivalent document and identifying themselves as a Consumer.

Acceptance

    By accepting these Terms and Conditions, the Consumer undertakes to fully and unreservedly adhere to all the clauses set out at the time of contracting, guaranteeing in all cases

    a. That he or she is a person with the capacity to contract.

    b. That you have read, understand and accept these Conditions.

    The Consumer shall always and in all cases have access to these Conditions prior to the start of the product purchase procedure, and they may be stored and/or reproduced on a durable medium.
